Terms & Conditions

Please read these terms carefully before booking any service or using our platform.

Home Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the India Law Advocates website and services. By using the Platform, booking any service, or making a payment, you agree to these Terms. If you do not agree, please do not use the Platform.

You expressly accept these Terms by ticking the "I have read and agree to the Terms & Conditions and Refund Policy" checkbox at the time of booking. A record of such acceptance, including timestamp and IP address, shall constitute conclusive proof under Section 65B of the Indian Evidence Act, 1872.

1 Nature of the Platform

India Law Advocates is a technology intermediary that connects clients with verified, independent lawyers and advocates across India. We are not a law firm. We do not ourselves provide legal advice, legal opinion, consultation, drafting, notices, representation, or any other legal service. Our sole role is to operate the Platform, verify empanelled independent advocates, match users to a suitable advocate, and collect, on their behalf or on our own account (as applicable), the fees agreed at the time of booking. All legal services are provided by the assigned independent advocate in their individual professional capacity.

All lawyers listed on the Platform are independent professionals solely responsible for the advice, drafting, and representation they provide. No advocate–client relationship is created between you and India Law Advocates. Any such relationship is formed directly between you and the independent lawyer you are connected with.

The empanelled advocates on the Platform are independent professionals and no employer-employee relationship exists between India Law Advocates and any empanelled advocate, insofar as their act of tendering legal services is concerned. The legal services rendered by any empanelled advocate are the sole responsibility of that advocate, and India Law Advocates shall not be held liable for the same.

India Law Advocates is an 'intermediary' within the meaning of Section 2(1)(w) of the Information Technology Act, 2000 and complies with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

2 Platform Fees — What They Include

The consultation fee is for a single 30-minute consultation call with a verified lawyer who reviews the details you provide and gives general guidance on possible next steps. The consultation is advisory in nature and does not include drafting, notices, court filings, or representation.

A case review fee may be charged separately where a lawyer reviews documents or case papers in depth prior to or in connection with the consultation. The applicable amount, if any, will be communicated to you before payment is collected.

If the assigned advocate is unable to attend the scheduled call for reasons attributable to the advocate or the Platform, you shall be entitled to (i) rescheduling at no additional cost, or (ii) a full refund of the consultation fee under our Refund & Cancellation Policy. The case review fee, once the review has commenced, is non-refundable, save where the failure to complete the review is attributable to us or the assigned advocate, and otherwise as expressly provided in the Refund & Cancellation Policy.

3 Engaging a Lawyer for Further Work

If you wish to engage a lawyer to draft documents, send notices, file a case, or represent you in court, this is a separate paid service. The scope, fees, and timelines for that work are agreed directly between you and the lawyer. India Law Advocates is not a party to that engagement and does not set or receive those professional fees unless expressly stated.

4 No Guarantee of Outcome

Legal outcomes depend on facts, evidence, applicable law, and judicial discretion. Neither the Platform nor any connected lawyer guarantees any particular result. Information on this Platform is general and is not a substitute for advice tailored to your specific situation.

5 User Responsibilities

6 Payments

Payments are processed securely through our payment partner, Razorpay. We do not store your full card or banking details on our servers. All fees are quoted in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. Platform fees currently include the lawyer-match / consultation booking fee (for a single 30-minute session) and the case review fee. Any additional paid service introduced on the Platform in the future shall be notified before payment is collected.

Payments are processed by Razorpay Software Private Limited, an RBI-authorised payment aggregator, which acts as an independent data fiduciary under the Digital Personal Data Protection Act, 2023 in respect of payment data.

7 Refunds & Cancellations

The Refund & Cancellation Policy forms an integral part of these Terms. In the event of any inconsistency, the Refund & Cancellation Policy shall prevail in respect of refund matters. No refund shall be payable where the service booked has been rendered in full.

8 Intellectual Property

All content on the Platform — including the name, logo, text, and design — is owned by India Law Advocates and shall not be reproduced or reused in any manner without prior written permission.

You retain ownership of all documents and case papers you upload. You grant India Law Advocates a limited, non-exclusive, royalty-free licence to store, transmit, and share such materials solely with the assigned advocate for the purpose of the consultation. Any testimonial voluntarily provided by you may be published by India Law Advocates in anonymised form unless you consent otherwise in writing.

9 Limitation of Liability

To the maximum extent permitted by law, India Law Advocates shall not be liable for the acts, omissions, advice, or services of any independent lawyer connected through the Platform.

To the maximum extent permitted by applicable law, and save for liabilities arising from gross negligence or wilful misconduct:

10 Relationship with Empanelled Advocates

Advocates listed on the Platform are onboarded as independent professionals and not as employees, agents, partners, or representatives of India Law Advocates. The empanelment does not confer upon any advocate a right to salary, pension, emoluments, provident fund, gratuity, or any other employment benefit or financial entitlement of any kind.

The Platform's role is limited to facilitating the connection between clients and advocates. Each advocate remains solely bound by their own professional obligations under the Advocates Act, 1961 and the Bar Council of India Rules, and is responsible for maintaining the standards required thereof.

India Law Advocates reserves the right to delist or suspend any advocate from the Platform at its sole discretion, without assigning any reason and without incurring any liability to the advocate on that account.

Advocates are solely responsible for the legal advice, drafting, and representation they provide to clients connected through the Platform. India Law Advocates shall not be liable for any act, omission, error, or negligence on the part of any empanelled advocate.

11 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. The courts at New Delhi shall have jurisdiction over disputes arising out of these Terms.

12 Grievance Redressal

For any grievance relating to the Platform or these Terms, please contact our Grievance Officer. We aim to acknowledge grievances within 24–48 hours and resolve them within a reasonable period.

13 Communications Consent

By providing your mobile number and email address at the time of booking, you consent to receive service-related communications from India Law Advocates and the assigned advocate — including booking confirmations, payment receipts, consultation links, reschedule notices, and follow-up updates — via SMS, WhatsApp, email, and voice call, notwithstanding your registration on the National Do-Not-Call Registry / DND list under the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR 2018). Such communications are transactional and service-related in nature. You may withdraw consent for promotional communications at any time by writing to indialawadvocates@gmail.com; however, transactional communications essential to fulfilling your booking cannot be opted out of.

14 Force Majeure

Neither party shall be liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, war, riots, terrorism, strikes, lockouts, court closures, orders of government or judicial authority, failure of internet, telecommunications, or electricity infrastructure, or third-party payment gateway outages. The affected party shall notify the other party as soon as reasonably practicable, and performance shall be resumed once the force majeure event ceases. If the event continues for more than thirty (30) days, either party may terminate the affected booking and obtain a refund of unutilised fees, subject to the Refund & Cancellation Policy.

15 Amendment

India Law Advocates reserves the right to amend, modify, or update these Terms at any time. The revised Terms shall be posted on this page with an updated "Last updated" date, and where the change is material, an email notice shall be sent to registered users. Your continued use of the Platform or booking of any further service after such posting shall constitute your acceptance of the amended Terms. If you do not agree with any amendment, your sole remedy is to discontinue use of the Platform.

16 Severability

If any provision of these Terms is held by a court or tribunal of competent jurisdiction to be invalid, illegal, unenforceable, or contrary to any applicable law, such provision shall be deemed severed from these Terms to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. The parties shall endeavour to replace any severed provision with a valid provision that most closely reflects the original commercial and legal intent.

17 Entire Agreement

These Terms, together with the Privacy Policy, the Refund & Cancellation Policy, and the Cookie Policy (each incorporated herein by reference), constitute the entire agreement between you and India Law Advocates in respect of your use of the Platform, and supersede all prior or contemporaneous communications, representations, understandings, or agreements, whether oral or written, relating to the same subject matter. In the event of any conflict between these Terms and the incorporated policies, these Terms shall prevail except as expressly stated otherwise (for example, the Refund & Cancellation Policy shall prevail on refund matters).
